Welcome to UXPective. These Terms and Conditions ("Terms") govern your access to and participation in the UXPective ecosystem, including our website, UX Cohorts, live training, in-person events, workshops, global summits, design tours and our UX Certification programs.

By accessing our website, registering for a program, or purchasing a ticket, you agree to be bound by these Terms in full. If you do not agree to these Terms, you must not use our services.

1. Payment and Registration

  • Registration Completion: Your registration for any UXPective program, cohort, or event is considered complete only after the full payment is received and successfully processed.

  • Invoicing and Receipts: If you require an invoice for your purchase, please use the printable invoice or the email confirmation received immediately after your online registration. We do not mail physical invoices.

  • Pricing: All fees are subject to change without prior notice. However, once your payment is successfully processed, you will not be subject to any subsequent price increases for that specific registration.

2. Cancellation and Refunds Policy

  • Digital Goods & Cohorts: Due to the immediate access granted to our proprietary digital materials, all sales for online cohorts, digital courses, and recorded materials are strictly final and non-refundable.

  • Live Events: For live, in-person events, specific cancellation windows will apply as outlined on the event registration page.

  • Expulsion: UXPective reserves the right to cancel a participant’s registration or remove them from a cohort/event without a refund if they violate these Terms, particularly our Code of Conduct or Intellectual Property restrictions.

3. Content and Intellectual Property

The materials provided by UXPective are the result of extensive research and professional expertise. We strictly protect our intellectual property.

  • Ownership: All materials shared during programs, including but not limited to slides, frameworks, templates, documentation, videos, audio recordings, and syllabus structures (e.g., Cognitive Architecture, Neuro-Design frameworks), are the exclusive intellectual property of UXPective and its creators.

  • Prohibited Use: Participants are granted a single-user, non-exclusive, non-transferable license for personal, educational use only. You cannot use these materials for any commercial purpose. You may not copy, reproduce, distribute, publicly display, modify, sell, or share these materials in whole or in part with non-participants, on public forums, or within your own commercial offerings.

  • Account Sharing: Sharing login credentials to access digital content is strictly prohibited. We monitor access logs, and unauthorized account sharing will result in immediate termination of access without a refund and potential legal action.

4. Photography, Recording, and Media Rights

  • Our Rights: UXPective reserves the right to photograph, record (audio and video), and capture screenshots of all live online sessions, in-person events, and workshops. By attending, you grant UXPective the irrevocable right to use your image, voice, and likeness in marketing materials, social media, and future educational content without compensation.

  • Participant Restrictions: Participants are strictly prohibited from recording (audio or video), screen-recording, or capturing unauthorised photography during any live online session or workshop without prior written consent from UXPective.

5. Code of Conduct

Everyone who attends a UXPective live, online, or in-person session deserves a respectful, inclusive, and safe learning environment.

  • Expected Behavior: You agree to engage professionally, respect the instructors and fellow participants, and contribute constructively to the community.

  • Prohibited Behavior: Harassment, discrimination, hate speech, disruptive behavior, unauthorized solicitation (spamming), and disrespecting the privacy of other participants are strictly forbidden.

  • Enforcement: UXPective reserves the right to immediately suspend or terminate your access to the platform, cohorts, or live events without a refund if you are found to be in violation of this Code of Conduct.

6. Online Participation and Platform Policies

  • Live Online Training: Participants are expected to join live sessions on time, with reliable internet connections. Mute your microphone when not speaking to prevent background noise.

  • Platform Security: You agree not to interfere with the security or functionality of the UXPective platform, including introducing viruses, attempting to bypass security features, or scraping data.

7. UX Certification Program

  • Eligibility for Certification: Certifications are not guaranteed simply by purchasing a cohort. To be eligible, participants must meet all attendance requirements, complete mandatory assignments, and pass required evaluations to the satisfaction of the instructors.

  • Delivery: Certificates are issued digitally upon successful completion of the program requirements.

  • Participant Information & Verification: You must provide your legal name for certification. UXPective maintains secure records of certified participants and reserves the right to verify your certification status with prospective employers or third parties upon request.

8. Accessibility and Special Needs

UXPective is committed to providing an inclusive environment. If you require special accommodations for an in-person event or online learning platform, please contact our support team at least 14 days prior to the start date of the event or cohort. While we cannot guarantee all requests can be met, we will make reasonable efforts to accommodate your needs.

9. Limitation of Liability and Force Majeure

To the maximum extent permitted by law, UXPective shall not be held liable for direct, indirect, incidental, or consequential damages.

  • No Liability for Digital Goods: We are not responsible for lost, stolen, or destroyed digital goods or account access due to user negligence.

  • Travel & Expenses: For in-person events, UXPective is not responsible for any personal travel, accommodation, or incidental expenses incurred by the participant, even in the event of a cancellation or rescheduling.

  • Technical Issues: We are not liable for technical issues, internet outages, or software failures on the participant's end that prevent access to live sessions or course materials.

  • Force Majeure: UXPective is not liable for delays, cancellations, or disruptions to our services caused by events beyond our reasonable control. This includes, but is not limited to, natural disasters, severe weather, global pandemics, internet outages, government restrictions, strikes, or civil emergencies.

10. Modifications to Terms

We reserve the right to update, modify, or replace these Terms at any time without prior individual notice. The updated Terms will be posted on this page with a revised "Effective Date." Your continued participation in the UXPective ecosystem after any such changes constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in connection with these Terms, including the validity, invalidity, breach, or termination thereof, shall be subject to the exclusive jurisdiction of the courts located in India.
